Terms and Conditions

'We', 'Us' and 'Our' refer to What's On 4 Ltd. 'You' and 'Your' refer to the individual or organisation registered to participate in one or more award categories, or purchasing tickets for the awards ceremony.

The promoter of the What's On 4 Kids National Children's Activities Awards is What's On 4 Ltd.

Important note: Our acceptance of Your registration, or Your purchase of a ticket, brings into existence a legally binding contract between Us on these terms and conditions. Any term sought to be imposed by You in any purchase order or correspondence will not form part of the contract. Registration or ticket purchase will be deemed to be an acceptance of these terms.

Participation

Nominations are open to companies and individuals that publicly offer activities for babies and children, or provide services as defined by the award categories.

You may nominate Yourself or a company that You are associated with.

Companies and individuals may be entered in one or more award categories if relevant. Award categories are subject to change.

Before registering for any award categories, please ensure You have read the award category criteria and awards timeline, to ensure that You qualify for these awards and can attend the awards ceremony.

Upon receipt of Your registration form and payment, Your registration and participation will be confirmed.

Winners and Highly Commended are required to receive their award at the awards ceremony. You may send a representative in special circumstances and this is subject to Our agreement.

The display of the official nominated, finalist, highly commended or winner logo on Your website is mandatory in order to be included in the awards. These logos should be linked to www.whatson4kids.co.uk and will be forwarded to You as the awards progress. Please note that alteration of the logos in any way is not permitted. The awards hashtag is #whatson4kidsawards

Nomination and registration process

Once You are nominated You will receive an email with the link to register for the awards and select Your award category. You can also register directly from Your account on www.whatson4kids.co.uk

Once registered You do not need to re-register, even if You receive further communications regarding nominations, unless You wish to be entered in further award categories.

Nominees may choose not to be part of the awards by notifying Us by email to info@whatson4kids.co.uk within 10 working days of registering.

Successful registered nominees will be published on Our website once nominations have closed and this will be accessible via http and standard web browsers.

Those nominating, and registered nominees, also consent to their comments and reasons for specific nominations being published or made public at Our discretion. The details of the nominator, other than the nominator's name, will not be revealed unless their permission is requested and given.

Registration, invoicing and payment

For current fees please refer to the registration form.

Registration administration fees, including any card processing or booking fees applicable, are payable upon registration.

Payment must be made in pounds sterling by credit or debit card via the online account on www.whatson4kids.co.uk

If any amount properly due to Us under or in connection with these terms and conditions remains outstanding beyond the due date We may:

  1. charge interest on the overdue amount at the rate of 8% per annum above the base rate of Lloyds Bank PLC from time to time, which interest will accrue daily until the date of actual payment, be compounded quarterly, and be payable on demand; or
  2. claim interest and statutory compensation pursuant to the Late Payment of Commercial Debts (Interest) Act 1998.

Cancellations and amendments to registration

All requests for cancellations or transfers to registration must be received in writing. Changes will become effective on the date of written confirmation being received.

The appropriate cancellation charge will apply based on the cost of Your registration, excluding any card processing fees, booking fees previously applied or donations, as shown below.

15 calendar days or more No refund will be given

In the event of a registered nominee being unable to participate, We will accept substitution of another qualifying nominee on the condition that written notification of the substitution has been received by Us by the close of registrations date.

In the event of cancellation of the awards by Us, We will endeavour to inform all registered nominees, although please be aware that this is not always possible. All registration administration fees paid will be reimbursed in full, or the payment will be transferred in full to another event. We shall not accept liability for any consequential loss and shall have no liability to reimburse any other costs that may have been incurred, including transport costs, accommodation and similar.

You may move to an alternative award category at Our discretion. Please ensure You have read the award category criteria before You register to avoid errors. If You have any queries please contact us.

We reserve the right to change the awards timeline, including the date of the awards ceremony, and will communicate any changes to all registered nominees by email and make notices of any changes on www.whatson4kids.co.uk and on Our social media channels.

The organisers take no responsibility for the failure of communications, especially emails, to be received by nominees.

The organisers reserve the right to use comments, testimonials and feedback supplied for marketing purposes anonymously unless We are advised otherwise.

Voting process

Every care and consideration is made to ensure that voting is fair. Email addresses and IP addresses of all online voting are collected with online validation and random spot checks. By voting or nominating You are agreeing that We may contact You via email. You may opt out of email correspondence at any time.

Nominees, and others, should encourage voting but not vote on any parent's or voter's behalf, as this could lead to multiple votes from specific IP addresses being recorded and votes being automatically discounted without notice. Multiple votes or online votes may not be included, without notice, if We believe they are not genuine votes or if voting has been incentivised in any way. 

A candidate may be removed from the process should We believe their conduct to be damaging to Our brand, Our process or fellow nominees.

Determining winners, highly commended and finalists

Awards are made from online voting results, or judged as detailed in the award category criteria.

The finalists who receive the highest number of votes, or who are shortlisted by the judges, will be notified by email after the voting and judging closes and invited to the awards ceremony.

We reserve the right not to make an award in a particular award category.

If an entry receives an award, the manner and details of announcing this award is strictly within Our discretion. Entrants understand that all awards may not be given or publicised in the same manner.

There may be prizes for some of the award categories advertised. There is no cash alternative to the stated prize. We reserve the right to offer a similar prize, or a prize of equal or greater value, if the stated prize is unavailable. Prizes will be dispatched to the winners within 60 days of the awards ceremony unless otherwise agreed.

Our decision is final and no correspondence will be entered into.

Awards ceremony event and tickets

These terms apply to all tickets for the awards ceremony, however they are purchased and whoever purchases them. Buying a ticket is acceptance of these terms.

Who may attend

Winners and Highly Commended are required to attend the ceremony to receive their award. You may send a representative in special circumstances, subject to Our agreement.

One finalist ticket is available to each finalist business, regardless of how many categories that business is a finalist in. Guest tickets, industry tickets and standard tickets are available subject to availability. 

This is a business event. Attendance is strictly limited to those aged 18 and over. We reserve the right to ask for proof of age and to refuse admission where it is not provided.

Prices and payment

All ticket prices are quoted exclusive of VAT and are subject to a ticket platform fee per ticket. The applicable rate depends on the ticket type, the date of purchase, and whether You hold an active paid advertising subscription with Us. Discount and access codes are issued at Our discretion and may be withdrawn or amended at any time.

Payment is due in full at the time of booking. Tickets are not confirmed until payment has been received in cleared funds.

Cancellations, refunds and transfers

All tickets are non-refundable. Tickets may be transferred to another named attendee at no charge, provided We receive written notice of the change at least seven calendar days before the event and the replacement attendee meets the eligibility criteria for that ticket type.

Optional ticket protection is available from Our ticketing provider at the point of purchase. Ticket protection is a contract between You and the provider of that protection, not with Us. Any claim under it must be made directly to that provider, and We have no involvement in or liability for the outcome of any such claim.

In the event that We cancel the ceremony, We will refund the ticket price paid. We shall not be liable for any other costs You have incurred, including but not limited to travel, accommodation, parking or loss of business.

The event itself

All timings are approximate and may change on the night due to circumstances beyond Our control. We reserve the right to amend the format, content, running order, entertainment, host, menu and any other element of the event with limited or no notice.

Please advise any dietary or access requirements at the time of booking. We will make reasonable efforts to accommodate requirements notified after booking but cannot guarantee this.

There will be flashing lights, loud music, photography and videography at this event. By attending You consent to being photographed and filmed, and to those images and recordings being used by Us and Our sponsors for marketing and editorial purposes without further permission or payment. If You do not wish to be photographed, please tell a member of Our team on arrival.

A cash bar operates during the receptions, during dinner and at the after party. Alcohol will not be served to anyone under 18, or to anyone Our staff or the venue's staff consider to be intoxicated.

We and the venue reserve the right to refuse admission to any person, and to require any person whose behaviour is disruptive, offensive or unsafe to leave. No refund will be given in these circumstances.

You are responsible for Your own belongings. Neither We nor the venue accept liability for loss or damage to personal property, including items left in the cloakroom.

Tables and group bookings

Tables are limited and are allocated on a first come, first served basis. Table locations are allocated at Our discretion. Where a table is described as being in a particular area of the room, We will make reasonable efforts to honour this but reserve the right to relocate tables where necessary for operational or safety reasons.

Accommodation, parking and third parties

Any hotel rates, parking rates or other arrangements We publicise are provided by third parties. Your contract for those services is with the provider, not with Us. Rates, availability and terms are set by the provider and may change or be withdrawn without notice. We accept no liability in respect of them.

Data

We hold the data You provide when booking for the purposes of managing Your attendance, including dietary requirements, access requirements and seating. We will only contact You about this event using these details. Where necessary We will share attendee names, dietary and access requirements with the venue. Liability

Nothing in these terms limits or excludes Our liability for death or personal injury caused by Our negligence, for fraud, or for any other liability that cannot lawfully be limited or excluded. Subject to that, Our total liability to You in connection with the ceremony shall not exceed the amount You paid for Your tickets.

Force majeure

We shall not be liable to refund fees, or for any other penalty, should the awards be cancelled or changed due to war, fire, strike, lock-out, industrial action, tempest, accident, civil disturbance, epidemic or pandemic, government restriction, or any other cause whatsoever beyond Our control.

Entire agreement

These terms and conditions, together with the event details and Our contact details, set out the whole of Our agreement relating to the awards and the awards ceremony. These terms and conditions cannot be varied except in writing signed by a Director of Ours. In particular, no terms and conditions incorporated within Your purchase order, and nothing said by any person on behalf of Us, should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any goods offered for sale by Us. We shall have no liability for any such representation being untrue or misleading.
